The right to withdraw from the contract

1.Pursuant to the Act of May 30, 2014. on consumer rights (Journal of Laws of 2014, item 827) A customer who is a consumer has the right to withdraw from this contract within 14 days without giving any reason. The deadline to withdraw from the contract expires after 14 days from the date on which you came into possession of the item, or in which a third party other than the carrier and indicated by you came into possession of the item.

2. To exercise your right to withdraw from the contract, you must inform us by e-mail ceramigo.art@gmail.com of your decision to withdraw from this contract by an explicit statement (for example, a letter sent by email).

3. You can use the model withdrawal form, which was sent in the confirmation email, but it is not mandatory.

4. To keep the deadline to withdraw from the contract, it is enough for you to send information regarding the exercise of your right to withdraw from the contract before the deadline to withdraw from the contract.

5. Upon receipt of the statement electronically, the Store will immediately send the Customer who is a consumer electronic confirmation of receipt of the statement of withdrawal from the contract.

 Effects of withdrawal from the contract

1. According to art. 38 of the Act on consumer rights, the right to withdraw from a contract concluded remotely, in accordance with the Act, is not entitled to consumer in accidents

a) for the provision of services, if the entrepreneur has performed the service fully for the express consent of the consumer who has been informed before the provision that he will lose his right to withdraw from the contract after the entrepreneur has fulfilled the benefit;

b) in which the price or remuneration depends on fluctuations in the financial market, over which the entrepreneur has no control, and which may occur before the deadline to withdraw from the contract;

c) in which the object of the service is a non-prefabricated item, manufactured according to the consumer’s specification or serving to satisfy his individual needs;

d) in which the subject of the benefit are things that after delivery, due to their nature, are inseparably connected with other things;

2. In the event of withdrawal from the contract, the customer is obliged to return the goods to the address Ceramigo Art or hand it over to the person authorized by the Store to receive immediately, but no later than 14 days from the date of withdrawal from the contract, unless the store suggested that he will pick up thing. The returned product should be packed in a way that prevents its damage in transit.

a). If the Customer uses the right to withdraw from the contract, the Customer shall cover the direct costs of returning the goods.

b). In the event of withdrawal from this agreement, the Customer is returned all payments received from him, not including the cost of delivering the item.

c.). The reimbursement of the payment shall be made by the Shop using the same method of payment as the Customer used, unless the Customer has expressly agreed to a different method of return that does not involve any costs to him.

d.). The store may withhold the return of payment until receipt of the returned Goods (items) or until delivery of evidence of sending back the goods in connection with the withdrawal depending on which event occurs first.

e.). The consumer is liable for the decrease in the value of the item as a result of using it in a way other than necessary to determine the nature, characteristics and functioning of the item.

Complaints about the Goods1. Ceramigo Art as the seller is liable to the Customer being a Consumer within the meaning of art. 22 [1] of the Civil Code, under the warranty for defects in the scope specified in the Civil Code, in particular in art. 556 and art. 556 [1] – 556 [3] and subsequent Civil Code.

2. Complaints arising from infringement of rights guaranteed by law or under these Regulations should be addressed to ceramigo.art@gmail.com. Ceramigo Art undertakes to review each complaint within 14 days and in case it is not possible, to inform the customer within this period, when the complaint will be considered.

3. Failure to consider the customer’s complaint within the time limits indicated in 9.2. does not constitute recognition of the Complaint by the Shop Operator.

4. The customer will be notified about the settlement of the complaint, the same way as the complaint was sent, unless the customer reserves a different form of contact. The settlement of the complaint will be additionally sent electronically to the e-mail address indicated by the Customer.

Settlement of disputes and final provisions

1. A customer who is a Consumer may use non-judicial means of dealing with complaints and redress if interested. Disputes regarding online purchases can be solved through mediation proceedings before the Provincial Inspectorates of the Trade Inspection or before the arbitration court at the Provincial Inspectorate of Trade Inspection. The consumer may also use other methods of out-of-court dispute resolution and, for example, file a complaint through the EU ODR online platform, available at: http: //ec.europa.eu/consumers/odr/

2. In the absence of the Consumer’s interest in the possibility of using out-of-court dispute resolution, resolution of any disputes arising between Ceramigo Art and the Consumer will be subject to the competent courts in accordance with the relevant provisions of the Code of Civil Procedure.

3.The settlement of any disputes arising between Ceramigo Art and the Customer, who is not also a Consumer, will be subject to a court having jurisdiction over the seat of Ceramigo Art

4. In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of the Polish law shall apply.

Uprawnienie do odstąpienia od umowy

1. Zgodnie z Ustawą z dnia 30 maja 2014r. o prawach konsumenta (Dz. U. 2014 poz. 827) Klient  będący konsumentem ma prawo odstąpić od niniejszej umowy w terminie 14 dni bez podania jakiejkolwiek przyczyny. Termin do odstąpienia od umowy wygasa po upływie 14 dni od dnia, w którym weszli Państwo w posiadanie rzeczy, lub w którym osoba trzecia inna niż przewoźnik i wskazana przez Państwa weszła w posiadanie rzeczy.

2. Aby skorzystać z prawa odstąpienia od umowy, muszą Państwo poinformować nas drogą pocztową za pomocą e-maila ceramigo.art@gmail.com o swojej decyzji o odstąpieniu od niniejszej umowy w drodze jednoznacznego oświadczenia (na przykład pismo wysłane pocztą elektroniczną).

3. Mogą Państwo skorzystać ze wzoru formularza odstąpienia od umowy, który został przesłany w e-mailu z potwierdzeniem dokonania zakupu, jednak nie jest to obowiązkowe.

4. Aby zachować termin do odstąpienia od umowy, wystarczy, aby wysłali Państwo informację dotyczącą wykonania przysługującego Państwu prawa odstąpienia od umowy przed upływem terminu do odstąpienia od umowy.

5. Po otrzymaniu oświadczenia drogą elektroniczną, Sklep niezwłocznie prześle Klientowi będącemu konsumentem, drogą elektroniczną potwierdzenie otrzymania oświadczenia o odstąpieniu od umowy.

Skutki odstąpienia od umowy

1. Zgodnie z art. 38 ustawy o prawach konsumenta, prawo odstąpienia od umowy zawartej na odległość, zgodnie z ustawą, nie przysługuje konsumentowi w wypadkach

a) o świadczenie usług, jeżeli przedsiębiorca wykonał w pełni usługę za wyraźna zgoda konsumenta, który został poinformowany przed rozpoczęciem świadczenia, że po spełnieniu świadczenia przez przedsiębiorcę utraci prawo odstąpienia od umowy;

b) w której cena lub wynagrodzenie zależy od wahań na rynku finansowym, nad którymi przedsiębiorca nie sprawuje kontroli, i które mogą wystąpić przed upływem terminu do odstąpienia od umowy;

c) w której przedmiotem świadczenia jest rzecz nieprefabrykowana, wyprodukowana według specyfikacji konsumenta lub służąca zaspokojeniu jego zindywidualizowanych potrzeb;

d) w której przedmiotem świadczenia są rzeczy, które po dostarczeniu, ze względu na swój charakter, zostają nierozłącznie połączone z innymi rzeczami;

2. W przypadku odstąpienia od umowy Klient zobowiązany jest do zwrotu towaru na adres Ceramigo Art lub przekazać go osobie upoważnionej przez Sklep do odbioru niezwłocznie, jednak nie później niż 14 dni od dnia, w który, odstąpił od umowy, chyba że Sklep zaproponował, że sam odbierze rzecz. Odsyłany towar należy zapakować w sposób uniemożliwiający jego uszkodzenie w transporcie.

a). W przypadku skorzystania przez Klienta z prawa odstąpienia od umowy, bezpośrednie koszty zwrotu towaru  pokrywa Klient .

b). W przypadku odstąpienia od niniejszej umowy Klientowi zwracane są wszystkie otrzymane od niego płatności, nie obejmujące jednak kosztów dostarczenia rzeczy.

c.). Zwrotu płatności Sklep dokonuje przy użyciu takiego samego sposobu zapłaty, jakiego użył Klient, chyba, że Klient wyraźnie zgodził się na inny sposób zwrotu, który nie wiążę się dla niego z żadnymi kosztami.

d.). Sklep może wstrzymać się ze zwrotem płatności do czasu otrzymania zwracanego Towaru (rzeczy) lub do czasu dostarczenia dowodu odesłania tego towaru w związku z odstąpieniem w zależności od tego, które zdarzenie nastąpi wcześniej.

e.). Konsument ponosi odpowiedzialność za zmniejszenie wartości rzeczy będące wynikiem korzystania z niej w sposób inny niż konieczny do stwierdzenia charakteru, cech i funkcjonowania rzeczy.

Reklamacje dotyczące Towarów

1. Ceramigo Art jako sprzedawca odpowiada wobec Klienta będącego Konsumentem w rozumieniu art. 22[1] Kodeksu Cywilnego, z tytułu rękojmi za wady w zakresie określonym w Kodeksie Cywilnym, w szczególności w art. 556 oraz art. 556[1] – 556[3] i kolejnych Kodeksu Cywilnego.

2. Reklamacje, wynikające z naruszenia praw gwarantowanych ustawowo, lub na podstawie niniejszego Regulaminu, należy kierować na adres ceramigo.art@gmail.com Ceramigo Art zobowiązuje się do rozpatrzenia każdej reklamacji w terminie do 14 dni a w razie gdyby nie było to możliwe, do poinformowania w tym terminie Klienta, kiedy reklamacja zostanie rozpatrzona.

3. Nie rozpatrzenie reklamacji klienta w terminach wskazanych w 9.2. nie stanowi o uznaniu Reklamacji przez Prowadzącego Sklep.

4. Klient zostanie powiadomiony o rozstrzygnięciu zgłoszonej reklamacji tą samą drogą, jaką przesłana została reklamacja, chyba, że Klient zastrzeże inną formę kontaktu. Rozstrzygnięcie reklamacji zostanie dodatkowo przesłane drogą elektroniczną na wskazany przez Klienta adres e-mail.

Rozstrzyganie sporów i postanowienia końcowe

1.Klient, który jest Konsumentem, może w razie zainteresowania skorzystać z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń. Spory dotyczące zakupów internetowych można rozwiązać w drodze postępowania mediacyjnego przed Wojewódzkimi Inspektoratami Inspekcji Handlowej lub procesu przed sądem polubownym przy Wojewódzkim Inspektoracie Inspekcji Handlowej. Konsument może również skorzystać z innych metod pozasądowego rozwiązywania sporów i np. złożyć swoją skargę za pośrednictwem unijnej platformy internetowej ODR, dostępnej pod adresem:http://ec.europa.eu/consumers/odr/

2.W przypadku braku zainteresowania ze strony Konsumenta możliwością skorzystania z pozasądowych sposobów rozpatrywania sporów, rozstrzyganie ewentualnych sporów powstałych pomiędzy Ceramigo Art a Konsumentem, zostanie poddane sądom właściwym zgodnie z postanowieniami właściwych przepisów Kodeksu postępowania cywilnego.

3.Rozstrzyganie ewentualnych sporów powstałych pomiędzy Ceramigo Art a Klientem, który nie jest jednocześnie Konsumentem, zostanie poddane sądowi właściwemu ze względu na siedzibę Ceramigo Art

4.W sprawach nieuregulowanych w niniejszym Regulaminie mają zastosowanie przepisy Kodeksu cywilnego, przepisy Ustawy o świadczeniu usług drogą elektroniczną oraz inne właściwe przepisy prawa polskiego.
